T he bodies of local self-government shall not be part of the system of bodies of state authority. I t means that the state authority have no right to interfere with activity of local self-government, to form such bodies, to appoint officials of local self-government, to cancel their decisions, etc. B esides, according to part 1 of Art.

131 of the Constitution the structure of local governments shall be determined by the population independently. S pecific status of local self-government is provided also by guarantees fixed in articles of chapter 8 «Local government» of the Constitution. So, economic guarantees of such isolation (possession, using of municipal property is carried out by the population independently) are fixed in Art.

130. I n the centre of Art. 131 there is a guarantee of territorial independence of local self-government.

L ocal self-government shall be administered in urban and rural settlements and in other areas with the consideration of the historical and other local traditions. T he structure of local self-government bodies shall be determined by the population independently. C

hanges in borders of the areas in which local self-government is administered shall be made with the consideration of the opinion of the population of the corresponding areas. I n Art. 132 the issues of local importance (areas of jurisdiction of local self-government) are listed and defined: management of municipal property; formation, adoption and implementation of the local budget; establishment of local taxes and dues, ensuring of protection of public order; solution of other issues of local importance.

L egal guarantees of security of independence of local government are fixed in Art. 133. These guarantees are connected with the right of local self-government for judicial protection, the right for a compensation for additional expenses (emerging as a result of decisions, adopted by state authority bodies), ban on the limitations on the rights of local self-government fixed by the Constitution of the Russian Federation and the federal laws.

CONCLUSION

To summarize, it should be emphasized that local self-government is the level of democracy in which the citizen has the most effective opportunity to participate actively and directly in decisions made for all of society. The local self-government is a fundamental component of broader democratic structures and practices. By serving as a school of democracy and a training ground for national level politicians, local government provides the foundation for strong democratic institutions and practices. The development of local level democracy is an essential if not a sufficient condition for the consolidation of democracy at the national level.

I mplementation of the public power by local self-government is connected with such principle of the constitutional state, as free and autonomous functioning of civil society. T he local self-government is an institute of civil society like public associations of citizens, the commercial organizations, etc. S

o, it is close to the population, to civil society. A t the same time, bodies of local self-government are the closest to the state; in fact it is a link between civil society and the state. R ecognition of local government from the state is a necessary sign of the constitutional state and a democratic political regime. A

s it is stated in the Art. 12, in the Russian Federation local self-government is recognized and guaranteed. I t is independent within the limits of its authority, the bodies of local self-government are not a part of the system of bodies of state authority. In that way absence of local self-government testifies to an antidemocratic political regime.
